Will I be Allowed to Drive After a DUI Arrest?
In the state of Florida, if you are arrested for a DUI and your blood alcohol concentration (BAC) is over the legal limit (.08 or higher), the police officer who arrested you will retain your driver's license. The DHSMV will begin a 6-month suspension of your driving privileges, and if you refused to take the breathalyzer or other chemical test, that suspension could last for up to 18 months.
In order to get your license back and restore your driving privileges, you have to request a review by the DHSMV within 10 days from the date of your arrest. If you do not request this review in writing within that 10 day period, you waive your right to contest the suspension and your license will remain suspended. Therefore, it is important to talk with a lawyer as soon as possible, so that you can properly request this review.
